Probate and Estate Administration



After a death it is of concern to those who are left behind that the Estate is administrated with sympathy as well as efficiently.

The process involves the valuation of all the assets of the Estate, agreeing with the authorities any tax liability, applying to the High Court for a grant of Probate - if a Will has been left - or for a grant of Letters of Administration if no Will was made. With the benefit of that grant the assets are gathered in, debts paid off, and the resulting balance distributed among the beneficiaries in accordance with the provisions of the Will or as decided by Act of Parliament when there is none.

In some cases a trust may arise under the provisions of a Will or an intestacy and that trust could last for many years. It will normally require the advice and guidance of solicitors and, often, the assistance of a skilled financial adviser.
